Last updated: July 25, 2026. These terms of use ("terms") govern any project or engagement between you ("client") and Kingston Designer, operating as sole proprietor Alexandria J Horner, and developer company Take Out App Development, operated by Michael Thomas ("we," "us," "our"). By engaging our services, requesting a quote, or making a payment, you agree to these terms.

Agreements. No work begins until a signed agreement or written project confirmation is in place. Verbal discussions and informal chats (including WhatsApp messages) are not a substitute for a signed agreement.

Quotes and pricing. Quotes are based on the scope discussed at the time and are valid for 30 days unless stated otherwise. Final pricing is confirmed after a discovery call and may change if the scope changes.

Payment. A deposit is required before work begins, with the balance due on the schedule set out in your agreement. Work will not proceed, and files or final deliverables will not be released, until payment in full is received.

Communication. All project communication and approvals happen in writing (email or the messaging platform we've agreed on). This keeps a clear record for both of us and avoids misunderstandings about scope, feedback, or approvals.

Revisions. Each project includes a set number of revision rounds, outlined in your agreement. Additional rounds beyond that are billed separately.

Timelines. Estimated timelines are provided in good faith but depend on timely feedback and materials from you. Delays on your end may shift the delivery date.

Cancellation. If you cancel a project after work has started, deposits are non-refundable and you'll be billed for work completed to date. We reserve the right to pause or end a project if payment terms aren't met.

Ownership and intellectual property. Final files and deliverables transfer to you upon full payment. Concepts, drafts, and unused ideas remain our intellectual property and may not be used without permission. We retain the right to display finished work in our portfolio and marketing unless you request otherwise in writing.

Confidentiality. We treat client information shared during a project as confidential and won't share it beyond what's needed to complete the work.

Limitation of liability. We aren't liable for indirect, incidental, or consequential damages arising from the use of deliverables we provide, including business outcomes, revenue, or performance of an app, cookbook, or other product after launch.

Governing law. These terms are governed by the laws of Ontario, Canada.2. Branding, marketing, and design servicesCovers branding, social media campaigns, and packaging design.Brand assets (logos, colour palettes, style guides) are delivered in the file formats specified in your agreement.Social media campaign work includes strategy and content as scoped; ongoing management (posting, community response, ad spend) is billed separately unless included in your agreement.Packaging design deliverables are print-ready files; print production, proofing with a printer, and physical samples are the client's responsibility unless otherwise agreed.3. Custom cookbooks, e-recipes, e-books, and custom PDFsContent, recipes, or copy provided by you are assumed to be accurate, tested (where applicable), and yours to use.We are not responsible for the outcome of recipes, instructions, or advice contained in a cookbook or e-book once published.Final files are delivered as agreed (typically PDF); requests for additional formats (print-ready, EPUB, etc.) outside the original scope are billed separately.4. App design and development (Horned Toad Studio)Projects start at $10,000 CAD plus tax, covering a full business plan, monetization strategy, and access to our developers.This pricing and scope covers iOS only. An Android version is a separate project with its own quote and timeline.Final pricing depends on the full scope of your project and is confirmed after a discovery call.App store submission, approval, and ongoing compliance with Apple's guidelines are subject to Apple's own review process, which is outside our control and may affect launch timing.Post-launch support, updates, and maintenance are not included unless specified in your agreement.Changes to these termsWe may update these terms from time to time. The version in effect at the time you sign an agreement or make a payment applies to your project.
